In February 1999, I received a call from a lawyer at Hill Abra Dewar stating that she had instructions to retain my services as an expert witness in the case of Sawatzky v. Riverview Health Centre. She was representing the Manitoba League of Persons with Disabilities which had intervenor status.In Canada the admission of expert testimony depends upon the application of four criteria outlined in R. v. Mohan by Justice Sopinka. These criteria are: relevance; necessity in assisting the trier of (...) fact, the absence of any exclusionary rule; and a properly qualified expert. The lawyer believed that I could provide the court with relevant, reliable ethics testimony about surrogate decision-making and about medical futility-information that likely would be outside the experience and knowledge of the trier of fact. Transnational reproductive travel is a largely unfettered multibillion-dollar global industry that flourishes, in part, by capitalizing on differences in legal regimes, wages and standards of living, and cultural and ethical norms. Indeed, as Scott Carney explains with respect to the commercialization of human eggs for third-party reproduction, “internationalization has made oversight laughable. … [R]egulators are dogs with no teeth” . While professional organizations can introduce guidelines and nation-states can introduce laws, the fact is that patients can travel to places where (...) there are no restrictions on .. (shrink)

Health Care Ethics is another addition to the growing number of texts that attempt to provide a much-needed Canadian perspective on many of the issues that arise in the delivery of health care. The readings are divided into three parts: “The Nature and Context of Health Care Ethics”; “Decision-Making in Health Care”; and “Decisions Near the Beginning and End of Life.” Collectively, they cover a variety of different issues—pluralism and multiculturalism, resource allocation and rationing, consent, research involving human subjects, genetics, (...) abortion, assisted reproductive technologies, euthanasia, and assisted suicide. The editorial introductions to these issues, while well written, readable, and clear, are general and deliberately non-committal in assessing the different and competing approaches and arguments reflected in the selected articles in which these issues are discussed. Colonialism and Its Forms of Knowledge: The British in India by Bernard S. Cohn Empire and Information: Intelligence Gathering and Social Communication in India, 1780-1870 by Christopher A. Bayly.

R.I.G. Hughes presents a series of eight philosophical essays on the theoretical practices of physics. The first two essays examine these practices as they appear in physicists' treatises (e.g. Newton's Principia and Opticks ) and journal articles (by Einstein, Bohm and Pines, Aharonov and Bohm). By treating these publications as texts, Hughes casts the philosopher of science in the role of critic. This premise guides the following 6 essays which deal with various concerns of philosophy of physics such as laws, (...) disunities, models and representation, computer simulation, explanation, and the discourse of physics.
